Atiku Strongly Appeals to Tribunal: Let’s Validate INEC’s Verdict of His 21-State Victory

The Peoples Democratic Party (PDP) and its presidential candidate, Atiku Abubakar, have emphasized that the Independent National Electoral Commission’s (INEC) acknowledgment of Atiku’s victory in 21 states during the last presidential election has not been refuted by the commission or any other party before the Presidential Election Petition Court.

In his final written address submitted to the court, Atiku asked the Election Petition Court to uphold INEC’s declaration that he won 21 states during the February 25 exercise. This address was filed on July 20 in support of his joint petition with the PDP, seeking the nullification of INEC’s declaration of Bola Tinubu as the winner of the poll.

In response to Atiku’s petition, INEC stated that the PDP presidential candidate had indeed won 21 states in the last election. The named states are Adamawa, Akwa Ibom, Bauchi, Bayelsa, Borno, Delta, Ekiti, Gombe, Jigawa, Kaduna, Katsina, Kebbi, Kogi, Kwara, Nasarawa, Niger, Osun, Sokoto, Taraba, Yobe, and Zamfara.

Given that INEC admitted to Atiku’s victory in these states and did not challenge this assertion throughout the proceedings, Atiku argues that the Tribunal should uphold the declaration.

Atiku’s final written address quotes INEC’s admission, stating, “The 1st Respondent further avers that in compliance with extant laws and regulations, it diligently discharged its duties when it collated the 1st Petitioner’s (Atiku) scores at the election, which aggregates to 6,984,520, winning only 21 States…”

Atiku’s legal team highlights that INEC’s admission constitutes an acknowledgment that requires no further proof and also constitutes an admission against interest.

Atiku contends that the election was held on February 25, 2023, and that INEC manipulated the technologies put in place to ensure transparency, wrongfully declaring Bola Tinubu, the candidate of the ruling party, the All Progressives Congress (APC), as the winner on March 1, 2023, despite a substantial percentage of the results not being transmitted for verification as required by law.

In light of these arguments, Atiku Abubakar prays that the court upholds INEC’s assertion and declares him the winner of the February 25 exercise.
