Court Reserves Judgment in APM’s Presidential Election Petition: The Nail-Biting Verdict Awaited

The Presidential Election Petition Court (PEPC) has reserved judgment in the petition by the Allied Peoples Movement (APM).

The verdict in the APM’s petition seeking the nullification of Tinubu’s election has been put on hold by the Presidential Election Petition Court (PEPC). The APM claims that Tinubu’s running mate, Kashim Shettma, was not qualified to contest due to allegations of double nomination.

After parties adopted their final written addresses, the chairman of the Panel, Justice Haruna Tsammani announced that judgment was reserved until a date to be communicated to parties.

Justice Haruna Tsammani, the chairperson of the panel, revealed that judgment would be reserved for now. The court will communicate the date to the involved parties later.

Justice Tsammani added that the court plans to deliver judgment in the petition by the APM the same day with those of the Peoples Democratic and Labour Party.

Justice Tsammani also mentioned that the court intends to deliver the verdict regarding the APM’s petition on the same day as the petitions by the Peoples Democratic Party and the Labour Party.

Respondents in the petition are the Independent National Electoral Commission (INEC), the APC, Tinubu, Shettma and Kabir Masari (who acted as APC’s placeholder before Shettma’s nomination).

The respondents in this case include the Independent National Electoral Commission (INEC), the All Progressives Congress (APC), Tinubu, Shettma, and Kabir Masari. Masari temporarily served as the APC’s placeholder before Shettma’s nomination.

The APM’s petition is anchored on the sole ground of non-eligibility of the APC presidential ticket, wherein they have raised the issue of the placeholder, Kabiru Masari as the Vice Presidential nominee of the APC and his eventual replacement with Kashim Shettima.

The APM’s petition is primarily based on the argument that the All Progressives Congress (APC) presidential ticket was not eligible. They raise concerns about Kabir Masari, who initially served as the APC’s Vice Presidential nominee but was later replaced by Kashim Shettima.

According to the APM, there is no such thing as a placeholder.

The APM argues that the concept of a placeholder does not exist.

The respondents adopted their final written addresses on the point of law, urging the court to dismiss the petition which is dead on arrival, as it ought not to be filed in the first place. The petitioners adopted their final addresses urging the court to allow the petitions on the grounds that it was meritorious.

The respondents, through their final written addresses, urged the court to dismiss the petition, claiming it was dead on arrival and should not have been filed. On the other hand, the petitioners presented their final addresses, requesting the court to consider the petitions since they were meritorious.

The APM’s petition was adjourned twice to enable them to obtain a copy of the May 26, 2023 Supreme Court judgment which settled the issue of the non-qualification of Bola Tinubu and Kashim Shettima over alleged double nomination of Shettima.

The APM’s petition was previously adjourned twice in order for them to obtain a copy of the Supreme Court judgment from May 26, 2023. This judgment settled the matter concerning the alleged double nomination of Kashim Shettima and Bola Tinubu.

The APM had called its sole witness, one Aisha Abubakar, an assistant welfare officer of the party, who admitted to being aware of the Supreme Court judgment delivered on May 26, dismissing the suit on allegations of double nomination against Kashim Shettima, instigated by the Peoples Democratic Party.

During the trial, the APM brought forward its sole witness, Aisha Abubakar, who holds the position of assistant welfare officer in the party. Abubakar confirmed her knowledge of the Supreme Court judgment delivered on May 26. This judgment dismissed a case regarding the allegations of double nomination against Kashim Shettima, which had been initiated by the Peoples Democratic Party.
