Deadline Set: DSS Has Seven Days to Charge Emefiele or Set Him Free

Justice Hamza Muazu issues ultimatum to DSS in Emefiele’s case

Justice Hamza Muazu of the Federal Capital Territory High Court, Abuja, has given the Department of the State Security Service (DSS) a one week ultimatum to either charge or release the suspended Governor of the Central Bank of Nigeria (CBN), Godwin Emefiele.

The ruling comes as a response to a fundamental human rights suit filed by Emefiele against the DSS and other parties.

The judge acknowledged that Emefiele has not proven the unlawfulness of his arrest and investigation but emphasized that he has the right to a fair hearing.

Justice Muazu further stated that the DSS cannot continue detaining the suspended CBN governor without formal charges. He also emphasized that this detention period cannot be used by the DSS to gather evidence against Emefiele.

The judge affirmed that while the DSS has the power to carry out its constitutional duties, including making arrests and detaining individuals, these duties must be carried out within the confines of the law.

Emefiele’s pursuit of justice

In his suit, Emefiele had sought the enforcement of his fundamental human rights, namely freedom of movement and dignity of life. He requested that his arrest and detention, which have been ongoing since June 10, be declared void and set aside.

Moreover, Emefiele demanded a compensation of N5 million as exemplary damages for his alleged unlawful detention.

The sequence of events

On June 9, Emefiele was suspended from his role as CBN governor. Less than 24 hours later, in the early hours of June 10, he was arrested at his home in Ikoyi, Lagos by the DSS.

It is important to note that Emefiele has remained in detention since his arrest.
